In a major patent infringement fight, Microsoft shot a fiery fire ball on Salesforce.com by lodging yet another federal lawsuit case over infringement. On Tuesday, Microsoft lodged a complaint against this minor online software company for over nine unique patents. The case filed in the federal court of Seattle seeks for both, temporary or permanent injunctions along with the monetary damages to the company losing the battle. According to the resources, the company is looking out for a jury trial while is also demanding for triple the amount of damages faced by it. Apart from this, Microsoft also claims that Salesforce should be ordered by the court to rightly pay the legal fees of the court along with the other expenses suffered during the lawsuit. What appears from the lawsuit is that Microsoft is sure about the infringement case.
In a statement, Microsoft’s Deputy General Counsel, Horacio Gutierrez stated that the company has been the leader and also pioneer in the entire Software industry for over decade’s time. It has been investing billions in the designing and launch of new softwares and services for its esteemed clients, market and sponsors. Gutierrez also stated that the company is aware of its responsibility for its partners, shareholders and other related to the company and hence feels that it is its duty to safeguard the investment during such infringements.
According to the studies performed, these infringements cover a wide variety of the user interface and back end features such as the system and method used for displaying a web page with embedded menu, etc. Microsoft is believed to have notified Salesforce.com for the first time near about a year ago regarding these infringements. On the other hand, representatives from Salesforce.com declined to comment on this case against Microsoft. So, let’s wait and watch on what happens to this new patent lawsuit case, as the outcome in these litigations is always uncertain.
